Gambling does not include bona fide business transactions valid under the law of contracts, including but not limited to contracts for the purchase or sale at a future date of securities or commodities, and agreements to compensate for loss caused by the happening of chance, including but not limited to contracts of indemnity or guaranty and life, health, or accident insurance."
(5) "Gambling device means any device, machine, paraphernalia, or equipment that is used or usable in the playing phases of any gambling activity, whether that activity consists of gambling between persons or gambling by a person involving the playing of a machine."
The combination of these two parts of the law basically means that all forms of gambling that would take place online are unlawful, and furthermore, computers would constitute gambling devices when used for the purpose of gambling.
With that, while unlawful physical gambling apparatus has been seized in the past and illegal operators prosecuted, even though the code calls for a Petty Misdemeanor with up to a $1,000 fine and up to thirty days in jail for people playing illegally, we have never found an example of anyone being prosecuted for the mere act of acting as a player.
The result of all of this is that the majority of online gambling sites that offer their business in other U.S. states also offer their services in Hawaii.
