The letter of the law in the State of Kansas is that the making of a bet in any way that is not specifically authorized by the state can result in the charge of gambling, which the code defines as follows:
21-4303. Gambling.
Gambling is:
Making a bet; or
Entering or remaining in a gambling place with intent to make a bet, to participate in a lottery, or to play a gambling device.
Gambling is a class B nonperson misdemeanor.
Gambling is considered a Class B Misdemeanor in the State of Kansas if acting as a player and the law comes with much stricter possible penalties for commercial operators of illegal gambling, which you can read more about on the above-linked restrictions page if you like.
One area of confusion...
...as to whether or not online gambling qualifies as illegal gambling is the fact that Kansas attempted, at one time, to introduce a bill specifically making gambling online illegal. That seems kind of strange because the law already makes it illegal to make any kind of bet other than those specifically authorized by the state.
So to specifically make online gambling illegal AND extend the same possible charge and penalty to online gambling seems quite a bit redundant, at least to us.

It seems some sites believe that, if the law does not specifically address, “Online,” then online gambling is not illegal, so maybe that’s what the attempted piece of legislation was in response to. Here at LCB, we don’t want to mislead any players and while we are not attorneys, when the law says it is illegal to, “Make a bet,” we tend to believe that also covers online.
Anyway...
...the bill that was introduced in Kansas back in 2013 to specifically make online gambling illegal failed, mostly due to the fact that the existing laws already made it illegal, so any further law to specify online is completely redundant...especially since the charge level and penalties were also the exact same thing.
In any event:
we were unable to turn up anything that would indicate anyone had ever been arrested in the State of Kansas for online gambling while acting as a mere player, because in all likelihood, that has never happened.
