Also, the law that calls for imprisonment of up to thirty days for acting as a mere player in a “Gambling place,” reads as follows:
§ 11-19-21 Frequenting gambling place.
Every person who shall frequent any gambling house or place where gaming is practiced or carried on, not in the performance of official duty and not being the landlord of that place entering to view the premises, shall be imprisoned not exceeding thirty (30) days.
All of these statutes pertain to physical locations...
...so there doesn’t seem to be anything in the code that would address being a mere player playing from home in any way whatsoever. Again, the law was likely written before internet gambling was even a thing, but laws in some states are worded in such a way that online gambling would still fall under the law and some are not.
The Majority of Arrests
It occurs in the smallest state of the fifty that we could find centered around some sort of bookmaking operation or another. One of the bookmaking operations was conducted on the Internet, but again, the person arrested in that case was behaving as a bookmaker/operator rather than as a player.
We can find no instance in the entire state of anyone ever being arrested or charged for behaving as a mere player, except some of the people in the bookmaking endeavors might have just been there to place bets rather than handle operations.
...being arrested in connection with bookmaking operations and playing online from your own home are two vastly different things.
