Two specific claims suits were filled- one for the 2,539 acres lost in the town of Perth and the other for more than 10,000 acres lost in the 1892 surrender, which amounted to nearly two-thirds of its land. The second claim was accepted in 2008 for negotiation based on its lawful obligation due to an invalid surrender.

The said surrender was conducted without the consent of the Order in Council, which actually represents the necessary step in the surrender process. Most of the land was sold to the individuals, except for 169 acres which was returned to the Tobique band in 1965.

Another major problem the Tobique First Nation is involved with is the confrontation with the New Brunswick Power Corporation over uses of land and waters. Although the First Nation rejected the company's bid to construct a hydroelectric dam on the Tobique River several times, the company approved the construction of the Mactaquac Dam in south-central New Brunswick without the First Nation’s consent.

Although the residents were offered the unlimited use of the dam’s power for domestic use and the business on the reservation, this was never honored and what’s even more- they were delivered power bills. Tobique refused to pay those and went protesting, claiming that the river damming resulted in environmental problems.

Although there are still negotiations on sharing the benefits from the dam, nothing significant has been accomplished as of yet.
