Update: German State Treaty Receives Another Dose of Criticism from the EC

No compliance with EU rules, says the Commission

Another wave of criticism of the monopoly-minded signatories to the latest German Treaty on gambling arrived this week from the European Commission, which also announced potential infringement proceedings.

Namely, in its opinion against the German State Gambling Treaty, the Commission has once again confirmed that it believes the proposed Treaty is in breach of EU law and that if the draft is not significantly changed after this warning, Germany risks formal infringement proceedings, referral to the European Court of Justice (CJEU) and ultimately financial penalties.

The EC marked several provisions of the Treaty as problematic and conflicting to the EU laws. One of these is the fact that the draft law pretends to open the market for online sports betting operators from all EU member states, but actually largely reserves the market for the incumbent German monopolies.
