Brazil Opens Consultation on Betting Licensing

The Secretariat of Prizes and Bets (SPA), part of Brazil’s Ministry of Finance, has opened a public consultation to collect contributions that will help shape updated regulations for betting operator authorizations.

Public Consultation Notice SPA/MF No. 3/2026 was published in the Federal Official Gazette on July 22, 2026. The initiative gathers information for a new ordinance that will establish rules and requirements for companies seeking authorization to commercially operate fixed-odds betting.

The consultation follows the SPA’s regulatory agenda, which included a review of the betting authorization process during the first quarter of 2026. The review focuses on improving procedures established under SPA/MF Ordinance No. 827/2024, which introduced requirements for obtaining authorization within Brazil’s regulated betting market.

The contribution period will run for 45 days, beginning on July 27 and ending on September 9, 2026. Individuals and legal entities can participate through the Brasil Participativo Portal using their gov.br accounts. After the consultation closes, the SPA will assess submissions according to procedures established under Article 31 of Decree No. 12,002/2024.

Regulator Seeks Input For Updated Authorization Rules

The consultation represents another stage in developing Brazil’s fixed-odds betting framework. The SPA intends to use feedback to refine the authorization process and incorporate experience gained from the first licensing cycle.

The future ordinance will define conditions operators must meet before receiving approval to offer fixed-odds betting services. The process is supported by Law No. 13,756 of December 12, 2018, Law No. 14,790 of December 29, 2023, and Article 29 of Decree No. 12,002 of April 22, 2024.

The notice was signed by Daniele Correa Cardoso, Secretary of Prizes and Bets at the Ministry of Finance.

The consultation comes as Brazilian authorities continue developing oversight mechanisms for the regulated betting market. The SPA has recently expanded monitoring activities, including assessments of whether operators provide consistent information through the Betting Management System.

Transparency Remains A Focus In Licensing Oversight

The consultation follows broader efforts to increase transparency around Brazil’s betting authorization process. In June, Finance Minister Dario Durigan announced that the ministry would publish more than 25,000 documents related to betting licenses as part of a commitment to greater public access.

Earlier, the Ministry of Finance introduced Administrative Order No. 2,126, creating a task force focused on strengthening transparency in gambling company licensing procedures.

The SPA has also reported changes in player protection activity within the regulated market. During the World Cup period, the regulator recorded an increase in self-exclusion requests from users of licensed betting platforms. The average daily number of requests during the first two weeks of the tournament was 588% higher than during a comparable period in May.

Current figures from the SPA indicate that 3.8 million people are prohibited from accessing licensed betting platforms in Brazil.

The consultation gives market participants and members of the public an opportunity to contribute to the next stage of Brazil’s regulatory structure. After reviewing submissions, the SPA will use the collected information to prepare updated authorization rules for fixed-odds betting operators.
