Did December Bring Any Significant Updates to Gambling Sector?

As dynamic as it is, both the land-based and online gambling sectors are undergoing constant changes, with a simple goal- to create and maintain a safe and entertaining gambling environment. Speaking of, the time has come to introduce you to the most recent set of updates that have marked the industry in the final month of the year.

If things are to judge by the surface only, the industry in general was mainly focused on regulations related to the advertising of gambling products. Multiple countries and states worldwide came up with new regulations for this particular segment, aiming to bring more responsibility to the sector.

Updates from LatAm Region

Let’s start with Brazil, where President Jair Bolsonaro failed to sign the sports betting regulatory bill (Bill 846/2018). As a small reminder, the deadline for this was December 12, 2022. As the original law which legalized this activity (Law No. 13,756) defines, the Ministry of Finance had to pass legislation to regulate it by the end of the current year. Now that the deadline has passed the destiny of sports betting remains unclear.

On the other hand …

…the Ministry of Agriculture greenlighted a new National Racing Code thanks to which jockey clubs are permitted to offer horse race betting. Up to this decision, the only private company authorized by the Ministry to conduct horse race betting was Betsson, via an agreement with the Rio Grande do Sul racetrack.

As for Chile, The Chamber of Deputies approved the ban on the advertising of sports betting in sports events and via any type of partnership with clubs and leagues. Before going to the Senate for approval, the bill will be drafted further in the Sports Commission in the lower house.

Finally, in ParaguayConajzar re-granted the sole sports betting license to Daruma SAM S.A. The validity period of the license was five years.

Highlights from the United States and Europe

In New York, Senator Pete Harckham presented legislation to the Senate suggesting that the Gaming Commission should develop regulations to ban “predatory sportsbook bonuses”. According to the Bill, such bonuses encompass deposit bonuses, deposit matching, free bets, site credits, and profit boosts.

As for South Carolina, representative J. Todd Rutherford pre-filed a constitutional bill ahead of the 2023 legislative session. This Bill aims to authorize and regulate casinos, sports betting, and advance deposit wagering on horseraces.

Meanwhile in Europe…

… the Committee on Culture in Sweden rejected proposals to introduce more rigorous advertising standards for “high-risk” gambling products. As they explained, there’s no need to make changes to the marketing rules as it was too soon since the introduction of the new regulatory system.

Speaking of marketing, the legislators in Romania presented the Senate with two bills aiming to reduce gambling ads. One of the bills completely prohibits all forms of gambling ads, whereas the other aim to prohibit such advertisements in public spaces and sending unsolicited messages in which gambling is offered.

Furthermore…

…the gambling tax in the Netherlands was increased to 29.5%. Also, KSA informed all licensees that cashback bonuses are prohibited, and also banned the use of bonuses that aim to encourage players to reactivate their accounts. Also, the regulator ordered Holland Casino to remove advertisements for its land-based casinos from its online gaming sites as gambling advertising laws do not permit it.

In NorwayNorsk Rikstoto’s monopoly license for horserace betting has been extended for 10 years. As for Switzerland, the local gambling regulators added 64 more domains to its unlicensed sites blacklist.
