India is poised to roll out its new online gaming regulations starting October 1, 2025, as announced by Union Minister for Information and Technology, Ashwini Vaishnaw, during the AI Impact Summit 2026 pre-event ceremony. The Promotion and Regulation of Online Gaming Bill, 2025, which received presidential assent on August 22, lays the foundation for a clearer regulatory framework in the fast-growing digital gaming space.
The law aims to encourage growth in e-sports and social gaming while placing strict restrictions on money-based online games, particularly those involving financial transactions, advertisements, and banking support.
Consultation Remains Key Before Implementation
Addressing the summit, Vaishnaw highlighted the government’s extensive engagement with stakeholders, including online gaming firms, banks, and industry bodies, before finalising the legislation.
“We have had multiple discussions with them, and after passing the law, once again, we engaged with them,”Vaishnaw said. “We engaged with practically every stakeholder possible in this, and we have finalised the rules.”
He added that another round of talks with the industry would be held before the law officially takes effect, underscoring the government’s willingness to adapt based on feedback.
“In case we need some more time, we will definitely look at a more consultative approach. At present, the government is targeting October 1 for the rollout of the new legislation,” he added.
Scope and Impact of the New Law
The Promotion and Regulation of Online Gaming Act, 2025 introduces a blanket ban on online games played for stakes, regardless of whether they are categorised as games of skill or chance. Participation in or operation of such games is now a cognisable and non-bailable offence, raising the stakes for companies operating in the sector.
The legislation also blocks banking services, advertisements, and promotional campaigns tied to money-based games, a move intended to choke off financial and marketing support for these platforms.
However, individuals who engage in money-based gaming will not face penalties. The law is focused instead on service providers, promoters, advertisers, and financial backers of such games, according to sources.
Promoting Safe Digital Gaming
While clamping down on high-risk money games, the bill simultaneously seeks to support the growth of e-sports and social online games by granting them legal recognition and a clear regulatory path. This dual approach is designed to separate legitimate skill-based and community-focused gaming from gambling-style offerings that pose financial and psychological risks.
According to the government, this move will legally validate e-sports and establish a framework that nurtures skill-based digital entertainment.
Industry Response and Next Steps
The rollout of the law marks a significant moment for India’s digital gaming sector, which has seen explosive growth but also increasing scrutiny. By differentiating between safe, skill-driven games and exploitative money-based platforms, the government intends to bring greater accountability and structure to the industry.
As Vaishnaw emphasized, the final implementation timeline remains flexible, contingent on the outcomes of the final round of consultations. “Our government’s approach is very consultative on practically everything that we do,” he reiterated.
