    I just heard on the radio a story and just have to share it with ya and get your feed back.

    A woman who frequents a restaurant several times a week does NOT tip. Although she is happy with the service and the food she has never left a tip.

    The owner decided to ban her. She is no longer allowed to eat in his establishment. Do you think this was the right thing to do?

    Is it legal to ban a patron for not tipping. Tipping is not required by law. Yet at the same time it is morally wrong. 

    Do you agree with banning her?

  • Tipping, as far as I know, is voluntary.  Should she be banned?  No.  She's still a paying customer.  Of course, Lord only knows what the disgruntled staff is putting in her sandwich....

  • Well, due to laws, the owners DO have the right to ban patrons. Reasons may vary though.  Had I been a server and such, I'd NOT want a person who I KNEW wouldn't tip me no matter what I did.

    Now, the crux of this is that (If you recall) I posted about a couple who refused to pay the gratuity ("No Tip? Call the police!) and were arrested. I stand by that as they and this patron KNOWS that this is in place.

    So, if you're going to eat out, if you don't plan to tip, then hit the local Mickey D's, they won't give a darn.

  • If I owned the place I would have at least talked to the customer. I would explain that none of my staff wants to wait on you because you don't leave tips and thats what they are serving you for, then if they still refused to tip I would tell that person they are no longer welcome because it's causing conflict with my employees!

  • Wait staff make less than minimum wage and depend on tips for their income. They are also required by IRS law to pay taxes on 8% of sales so when someone does not tip, the server still pays income taxes on the person's meal. 

    I think it is the business owner's right to ban a patron especially since the restaurant owner is not providing a unique service. There are thousands of other restaurants this person can frequent and if they do not want to tip, they should order carryout or eat at places that are not full service rather than using a service that they don't want to pay for.

  • Kick the dead-beat out of the resturant.  We have reached a point where people think eating out is an entitlement.  If you can't tip, please stay home or bag your lunch.

  • totally agree with you on this, lol, only Lord knows what a disgrunted staff put in her food.  Imagine that they catch a fly and cut into pieces and put in her food, dam, she will swallow million and million of viruses.  Dont mess with the food handlers, lol.

  • I agree with arizonadback, I do know that waiters/waitresses do pay the tax regardless.  But like satan said, try to talk to her, I guess we will never know if the owner tried that.

    Even if I get horrible service I still leave something. 

    Like gene said, go to Mickey D's if you don't plan on tipping! hehe

  • I think this is a multifold question/answer...

    On one hand, you say she frequents the place a few days a week.  We do not have all the variables here...is this woman old, living on a fixed income?  Maybe she likes to have a good meal, but can't cook for herself, and cannot afford to eat there daily and tip.

    On the other hand...as you say it although it is not a legal issue, i certainly do not think it a moral one either.  Whether or not I tip someone hardly increases/decreases my moral fortitude.

    I do believe however that all restaurant staff deserve a good tip.  Any restaurant of any calibre would have a specified gratuity requirement on the bottom of the check, or somewhere the patron would understand, that is part of the dealio...you want service...you have to tip. 

    You cannot depend on an implied tip, because there are always those that do not tip, right or wrong.

    I feel that the restaurant owner has done this woman an injustice by banning her from the restaurant.  If he was true to his field,  customer service is #1, and he should have taken the woman aside and found out exactly what her situation is, and gone from there.

    If it is a money matter, then he should have continued serving the customer, even if he had to wait on her himself.  His waitstaff gets paid from tips, he does not.  He should have just treated her as a special case, since she comes in all week, and it was probably more like her place to come home for dinner, than a restaurant.

    you know...i really am so sick of this winebag song.

    in the 70's i waitressed at brigham's...not a 5 star restaurant, and only made $2.64 waitress wages, but ended up making over $12.-$15 an hour
    with my tips.  That was a decent wage for a 16 year old, and for that time, certainly a decent wage.  Far exceeding minimum wage, that was probably only 4. something back then.  So I really don't think any waitress is hurting for money, if little debi, can make that kind of money at BRIGHAMS.

    I am just too simple when it comes to situation like this...
    It seems that this  woman is a faithful and regular customer which means great business-without regulars, difficult to continue the food business- maybe not so much to the servers but to the owner so instead of losing one more good customer and make everyone happy and be fair, I think this owner should pay the tips for her to his employees after customer leaves...he may lose some money from his pocket but he would still have his customer and his employees would continuously respect the customer and happy to give his/her best service then it brings more satisfied customers for the owner which means a better business for the future...(I wouldn't go talk to that customer ask why...it just doesn't feel right.)

    I agree with you deb if the server does not get tipped then they dont get paid. They are basically working for free. Obviously she liked this place enough to go several times a week. This tells me she was happy with the service as well.

    If she had enough money to buy a meal......then she has enough money to tip! I think its down right cheap and rude not to tip good service. I think its a case of walk in my shoes for a day......and see how you would like it!!

    We all are out there trying to make ends meet. If every patron was like this woman......the servers would be homeless.

    i am too...what makes you think it isn't the woman who cannot afford to pay a tip?  i am just looking at it from both sides, not necessarily taking an opinion either way.

    This the video (In case some haven't seen the parties involved) the crux is, that they say "She's a bad tipper, I find it interesting they didn't ask the lady "How much DID you tip on average?"

    I have also gone around the net and I am seeing ALOT of people saying the same thing "If you won't tip decently for good service, then don't go there" or "The manager has the right to ban you for lousy tipping"

    Of course, if I had access to the fortune cookies...Then.......
